Class Action Lawsuit Information

JUDGE CERTIFIES CLASS ACTION ALLEGING VIOLATION OF CHAPTER 9.60 OF THE FREMONT MUNICIPAL CODE AGAINST VILLAS PAPILLON, LLC. APPOINTS LAW OFFICE OF ANDREW WOLFF, P.C. AS CLASS COUNSEL

A lawsuit is pending in the Superior Court of California, County of Alameda (“the Court”) against Villas Papillon, LLC (“Defendant”). On January 16, 2015, the Court has approved the lawsuit as a class action. The Plaintiffs in this lawsuit claim that the Defendant has given the tenants who lived at 4022 Papillon Terrace, Fremont, CA (“Subject Premises”) unlawful rent increase notices. The Plaintiffs in this lawsuit also claim that the Defendant has unlawfully obtained releases of claims from the tenants who have lived at the Subject Premises. Plaintiffs allege that Defendant’s conduct violated Chapter 9.60 of the Fremont Municipal Code (“RRIDRO”) and therefore breached their contracts with these tenants, and violated the Unfair Competition Law (Bus. & Prof. Code § 17200 et seq.). Plaintiffs claim that the Defendant’s conduct caused tenants at the Subject Premises to pay unlawfully increased rents. Defendant denies any wrongdoing.

A court has approved, or “certified”, this case as a class action lawsuit that may affect tenants who lived at 4022 Papillon Terrace in Fremont, California at any time between June 14, 2009 through January 16, 2015. Judge George C. Hernandez, Jr. of the Superior Court of California for the County of Alameda is currently overseeing this case. The case is known as Fernandez, et al. v. Villas Papillon, LLC, et al., Case No. RG13683606. The people who sued are called “Plaintiffs”. The company they are suing (Villlas Papillon, LLC) are called “Defendants”.
