JUDGE CERTIFIES CLASS ACTION ALLEGING VIOLATIONS OF CIVIL CODE SECTION 1940.1 AND THE OAKLAND TENANT PROTECTION ORDINANCE AGAINST EMPYREAN TOWERS, LLC, PRIZE GROUP, LLC, INNOVISTECH REALTY COMPANY AND ALICE TSE (“DEFENDANTS”). APPOINTS LAW OFFICES OF ANDREW WOLFF, P.C. AS CLASS COUNSEL
A lawsuit is pending in the Superior Court of California, County of Alameda against Defendants. On January 10, 2018, the Court provisionally approved the lawsuit as a class action. The Plaintiffs in this lawsuit allege that Defendants instituted a policy requiring tenants to check out of their single room occupancies after 21 days in order to deprive tenants of long term tenancies in violation of Civil Code section 1940.1 and the Oakland Tenant Protection Ordinance. Plaintiffs also allege Defendants negligently hired, supervised and/or retained employees and violated the Unfair Competition Law. Defendants deny any wrongdoing.
The class is defined as all persons identified as a resident of the Empyrean Towers which is located at 344 13th Street, Oakland, CA who were required to check out pursuant to the relevant 21-day policy during the period April 8, 2014 through June 26, 2015.
